If you really knew the FDCPA you would know that a verbal cease and desist is not valid...
I got a call today just exactly like the one you received from someone called Joseph. He is calling me a work and it is definitely annoying.
I am getting calls from that number and joshep.saying he has a matter that may or may not affect me he said he has left several messages{becouse i dont call back} and it sounds like it is a recording becouse everytime it comes in it is the same wording everytime
where do i go to report them?
THEY MENTIONED LAST FOUR DIGITS OF SOCIAL AND THEY HAD THE WRONG PERSON.
FFG is not listed as a company acredited with the BBB. I checked in Maryland that is where I live and they have not filed any lawsuits against anyone. I work for an attorneys office and I dont believe this company is legit. They would not give me their address to send correspondence to and wanted to send me an email. I told him that I would not accept an email and that I wanted his address. I also advised him that FFG was ordered a cease to collect in April 2009. He told me to have my attorney handle this issue and then hung up on me.
Call comes up restricted and a Dan left a message stating that I was referred to his office due to pending litigation due to a possible traffice accident that I may have caused. Company uses decietful tactics to get call backs. When I called back and spoke to the collector - he answers as "Legal Departement" - takes my info then says "Ok hang on while I get your file from the attorney" - comes back online - says that I have a bill for x amount of money - plus $3000 for their retainer fee and ask if I would like to avoid litigation and pay the bill today! I advised Dan that this bill was settled a long time ago with the original creditor - to which he replies that he has no record of it and that if I dont pay in full today, he is going to garnish my wages. I advised Dan that in order to do so, he would first need to file the lawsuit - then serve me with the correct paperwork and then wait for a court date. Once the court date came - I would provide my receipts and the judge would throw the suit out and no judgement would be entered thus he would not be able to file for a writ of execution to attach any of my wages - at this point Dan hung up... They are just another collection agency who buys old debt - then they try to use whatever tactics they can get away with to recover any monies.
I just received a call at work from the same number and a man named Jay who asked which day would work best to settle this in courts. I asked to send me something in the mail verifying the debt and he said that he was sure that I had received something in the mail, and that this was just a courtesy call to allow me to not go to court. I didn't even ask what the debt was for, just told them to send me a letter verifying the debt and he told me to call him back at anytime today when I was available. There is another site with several people that have said they were sued by this company and to take them seriously, but also posts noting that these "take them seriously" posts were made up by people at the company. When I try to google the name of the company, the only references to be found are at forums such as these.
I've been getting phone calls from "Joseph" from FFG & Associates regarding a check I wrote and to please call him to verify information for security purposes 1-866-443-6985. He's is calling from 702-463-7934. I haven't asnwered or returned their call.
I get phone calls everyday from this company, however, today is the first day that they actually left a message and it was from a "Joseph" telling me to call back at the 866-443-6985 number. He didn't say what it was regarding or anything just to call him back as soon as I get this message. But every time I get these calls they are coming from a (702) area code which is Las Vegas.
